No TRO for Gwen Garcia's Suspension says CA

The Court of Appeals (CA) did not issue yesterday a temporary restraining order (TRO) that would lift the six-month preventive suspension imposed by the Office of the President (OP) on Cebu Governor Gwendolyn Garcia for alleged grave abuse of authority.

Instead, the CA required the OP and the Department of the Interior and Local Government to comment on Garcia's petition within five days.


The CA set oral arguments on Garcia's petition on January 10.

Despite the suspension order and her petition with the CA, Garcia has stood firm on her decision to stay in office.

She stressed that her suspension was illegal.


According to Garcia, the complaint against her for usurping her authority by slashing the budget for the salary of the contractual employees of then vice governor was flimsy and baseless.

She pointed out that the decision to transfer the funds to her office was approved by the Sangguniang Panlalawigan.

At the same time, she said the penalty imposed on her was too harsh. She stressed that she should have been reprimanded only.
